CELL C “WINC” PRODUCT TERMS AND CONDITIONS

- To get your cellphone number, simply insert your SIM card into your phone and your number will be SMS’d to you. Should you have any problems you can call Cell C’s contact centre on 140 free of charge from your cellphone.
- Once your SIM card has been registered (RICA), you can enter your PIN number into the cellphone and your Women Incorporated Winc starter SIM pack is connected! Your first outgoing call will activate the Cell C Network access timer and will allow you to make and receive calls and SMSs.
- All calls or SMSs made and any other access charges will be charged in accordance with the rates detailed in clause 4.1 below and Winc rates available from time to time on www.cellc.co.za.
- By purchasing and activating your Winc SIM card and complying with the provisions of clauses 1, 2 and 4, you qualify for the following:
- A flat rate of R1.50 (one rand and fifty cents) per minute on all voice calls made to all networks, including landlines, any time peak or off-peak. Save for clause 4.2 below, should you migrate to the per second tariff option, you shall still be eligible for all Winc benefits;
- A maximum of 30 (thirty) free SMSs per calendar month when you recharge with an amount of R25.00 (twenty-five rand) (“the free SMSs”). In this regard it is expressly noted that:
- Physical, virtual and electronic funds transfer (EFT) recharges that accumulate to R25.00 (twenty-five rand) or above made in 1(one) calendar month will qualify;
- The free SMSs will be loaded within 24 (twenty-four) hours that the recharge amount of R25.00 (twenty-five rand) has been reached;
- You must utilise the free SMSs within the month that you receive it, failing which you shall forfeit any unused free SMSs in the following month(s); and
- Recharges exceeding R25.00 (twenty-five rand) shall not entitle you to additional free SMSs. The free SMSs shall only be awarded to you once every calendar month should the provisions of clause 4.2 be met.
- Toll-free calls to LifeLine: 0800 150 150; and
- Upon successfully completing the registration process, exclusive access to the Winc WAP site, www.winc.mobi.
- Cell C shall donate 1 (one)% of the net annual revenue generated from calls made by Winc subscribers to ‘Women in Confidence’ and/or any other relevant female causes that Cell C in its sole and absolute discretion elects to donate to (“the donation”). Cell C reserves the right to revoke, replace, vary or amend the donation at any point in its sole and absolute discretion.
- In order to download content, cellphones have to be content-compatible and WAP-enabled.
- Cell C is under no obligation to render any account in respect of the usage of credit values and/or the period of access to the network or any other information in respect of call records and/or recharges.
- Cell C makes no guarantee, warranty or representation howsoever in relation to the Winc SIM pack, SIM card, any recharge vouchers or the Cell C Network.
- Cell C reserves the right, in its sole discretion, to change any of the time periods referred to herein.
- If required, as a result of changes in legislation, or for any other reason, Cell C shall have the right to terminate this Winc starter SIM pack immediately and without notice to you. In the event of such termination, you agree to waive any rights that you may have in terms of this promotion and acknowledge that they will have no recourse against Cell C, its directors, agents, employees and promoters.
- Cell C shall be entitled to vary, replace or revoke the benefits of the Winc starter SIM pack in its sole and absolute discretion, without notice to you, and you shall be deemed to have accepted such amendments.
- Risk in and to any items contained in the Winc starter SIM pack, or any recharge vouchers shall pass on delivery, therefore Cell C shall have no liability for any item which is lost or stolen.
- Do not accept any recharge voucher if the seal has been broken or tampered with.
- Report to the police within 24 hours, and notify Cell C in the event of losing your SIM card and/or cellphone. A lost SIM card can be replaced by a SIM swop at applicable rates (cost will be on Cell C’s website at www.cellc.co.za). To secure the same cell number, an ID document and the original certificate containing the SIM Card Registration Number and PIN number must be presented to an authorised dealer.
- Cell C reserves the right to suspend the Winc service or any part thereof or to disconnect the SIM card from the Cell C Network in the event of any unlawful use of the Winc service or any unlawful or unauthorised tampering with or modification to the cellphone or SIM card.
- Any dispute relating to the Cell C Network or Winc service may be referred to the Independent Communications Authority of South Africa (ICASA).
- To the extent permitted by legislation, Cell C reserves the right to contact you for marketing, promotional and other Cell C services.
- Whilst every effort has been made by Cell C and its suppliers of information to ensure the proper performance of every content service, Cell C, its affiliated companies, suppliers or any of their employees do not guarantee the availability of services, content and information offered. In particular we make no warranty that the content services will meet your requirements, be uninterrupted, complete, timely, secure or error free.
- We will only entertain request for exchanges, returns and/or refunds at our discretion. Errors will be billed in full.
- By using Cell C services you indemnify and hold us harmless against all and any loss, liability, actions, suites, proceedings, costs, demands and damages of all and every kind (including direct, indirect, special or consequential damages) and whether in action based on contract, negligence or any other action, arising out of or in connection with the failure or delay in the performance of content services offered or the use of said services.
- The purchase of Winc starter SIM pack and/or the use of any recharge vouchers constitutes acceptance of these terms & conditions.
